To qualify as a de facto of someone, your relationship must meet all of the following: You and your partner are in a mutual and committed relationship like a marriage or civil partnership in practice but not in law You have been cohabiting (living together) for at least two years Your relationship is genuine and continuing You are not related to each other by family Suppose you are a de facto to an Irish, UK, EEA or Swiss National or a non-EEA national work permit holder in Ireland. You may be permitted to live in Ireland with your partner. The application process time varies from four to six months. Benefits De facto might be eligible to seek employment without needing a separate work permit. Evidence that you and your partner have visited each other as often as you can during these two years will not be sufficient in itself to demonstrate a committed de facto relationship You are living with your partner at the time of the application. If you are not living together, you are required to give compelling reasons as to why your application should be granted Your partner is a resident of Ireland and is self-sufficient. A dependent spouse is a husband or wife who is actually and substantially dependent on the other spouse for maintenance or is substantially in need of support from the other spouse. They can only provide their Trusted Partner Registration number instead of all employer details. Reactivation Employment Permits are designed for situations where a foreign national entered the State on a valid Employment Permit but who fell out of the system through no fault of their own or who has been badly treated or exploited in the workplace to work legally again. The foreign national’s new employer or Future Direct can help you apply for a Reactivation Employment Permit. The Employment Permit is issued to the foreign national, and a certified copy is sent to the employer, which permits the employment in the State, in the occupation and location/s specified on the permit. Except in very exceptional circumstances, the Minister will consider the issue of one new Reactivation Employment Permit for a foreign national under this scheme. The application procedure involves the following two steps: Apply to the Department of Justice for a Stamp 1 permission letter based on the Reactivation Scheme. This letter acts as a visa extension for you to remain in Ireland and apply for a new work permit. Once the Stamp 1 Permission letter is granted, you can apply for a Reactivation Employment Permit with the DETE online. (You should note that, except in exceptional circumstances, employment permit holders are expected to remain with their initial employer for 12 months before moving to a new job). After this, you can get a Stamp 4 permission to live and work in Ireland without an employment permit.
